reader, anonymous, writes (11 April 2010): It's not actual rape, hence rape is when one doesn't want sex and it is physically forced on them.The law in Britain however, I THINK is if she is underage at all and he is not, then he could go to prison for it is illegal. It's not classed as physical rape exactly, because this was both under consent. It's classed as something else, on the lines of rape. As they say anyone who is underage is never 100% ready to have intercourse even though they think they are (the reason it is illegal)I'm not entirely sure though, I only know anything about this sort of thing through someone I know of went to prison for having sex with a 15 year old, even though it was under concent, but wasn't classed as rape.

Doesn't matter if it is male or female the law is the same, and it doesn't matter if the girl gets pregmant or not. Sex by force, against ones will is always rape no matter the age, male or female. In Britain this is statutory rape but it is doubtful that any charges would be brought because the age gap is so small. It is unofficially decided that the law is only implemented to protect the vulnerable from abuse. However, sadly the number of mothers under the age of consent is becoming a problem in britain (scotland especially) and, while i cannot speak for all circumstances, most of these young mothers have partners around or a few years older than the age of consent.
BUT, and this is very important, if said 17 year old was in any position of trust or authority in the life of the girl, it is considered to be much more serious and has resulted in legal action and even prison. I think this is something we have in common with you folks across the pond.

Depends where you live and the laws there.
If it was consensual sex, it could be classes as 'statutory rape' regardless. This is not as serious as a rape charge due to the consent factor, and carries lighter penalties, ... possibly (and usually) no jail time.
Where I live the legal age is 16, anything under is illegal, as is a 16 year old having sex with anyone more than 2 years older than them. At 18 it becomes a free for all.
Google the statutory rape laws for the area you live in to see what the particulars are for your locality.

Statuatory rape would only apply if he was 18. Because he would be an adult having sex with a minor.
