the accused and consented to the activity, it is not considered a crime.

If the answer required is a simple 'yes or no,' then the answer is no.
In the US, different states have different standards and this will have a bearing on the case.
It is only considered rape if a person who is an adult(18 and above)have sex with another person without her consent

In the US,the age of consent can varies from 13 to 18 depending on which state.

reader, anonymous, writes (8 May 2008): Where I am from, the age of consent is 16, which means that anyone 16 or under cannot consent to sex. But there is a margin whereby it is not a crime to have sex as long as there is no more than 3 years between you, ie. a 15 year old can have sex with a 16 year old with consent and it is not considered statuatory rape.

No, In the USA, it is not rape, as long as neither one of you is 18 and over. You're both under age and should probably consider holding out for a bit longer, but if you're really set on it, just know that it is not against the law to have sex. Just please be safe.

Yes it is rape. Because at the age of 15 the girl isnt considered by law old enough to consent to sex. At 15 you cant consent, therefore even if the girl says 'yes i want sex', that isnt considered consent because she isnt mature enough according to the law to decide if thats irght for her.
