writes: I'm 5 mouths pregnant and recently got fired because of it (I was a waiter). My ex-boss always had it out for me since day one said they needed more "skinner" waitress who could got more tips (so he could pay them less). When I told my husband about he went insane and he wants sue the company. When I think its a waste of time and money which we need to the baby. But he says I'm letting them take advance of me and they win. Should we sue even though I think its pointless.

The EEOC would probably handle this case as well. In fact, some lawyers will want you to go through them anyway since their decision will make their case much, much easier if that decision is in your favor.
Bottom line though, get your ducks in a row. Get testimony from anyone who heard or saw anything. If you don't, its nothing more than your word against his. Second bottom line is don't expect a whole lot fast. About the best you can hope for short term is the threat of action scaring him enough to hire you back. If I were planning on taking legal action, I'd go ahead and find another job. It'll save him offering to hire you back, then finding a reason to fire you later for cause so that he can squirm out from under the reason he fired you this time.

reader, anonymous, writes (18 February 2009): your husband is right, the only way they would win is if in the contract you signed when you started working there, it said in fine print they can fire you without cause... that happend to my mom, but its worth a try to get a lawyer and look into this, or atterny or w.e u need... its better to sue for ur damn rights and possibly get money out of it, then not try at all...

That is total discrimination and it is illegal. For an employer to fire you because you are pregnant is 100% illegal and he could get in serious trouble for it.

your husband is right! you do need to pursue this. there are lawyers who will do pro bono(for free) work if you can't afford to hire one. you need to go after them, you cant let them get away with it or they will think its ok and do it to other girls as well. stand up for yourself honey!!!
