person12345 agony auntLaws aren't based on schooling, they're based on age. It varies by state, but so long as he's not under 16 it's legal.

So_Very_Confused agony auntLike everyone has said.. it's NOT illegal to be out of high school and dating someone in high school...

now if you are 18 and he's under 16 then I would not be having intimate relationships with him till he's past the age of consent (check your state because it varies by state and even by sex)

chigirl agony auntBy heavens, where did you get the idea that it'd be illegal? No, dating isn't illegal. What's illegal is an adult having sex with a minor, and what classifies on minor depends on the age of consent in your country/state. If the age of consent is 16, and he is 15 while you are 16 or more, it is illegal for you to have sex with him.

But dating is fine. It's just the sex part.

A female reader, k_c100 United Kingdom +, writes (28 September 2011):

k_c100 agony auntHaving a relationship with someone a year younger than you is not illegal, regardless of whether you are still at school or not. What COULD be illegal is if you are having sex with him and he is under the age of consent in your state. And that would be illegal regardless of whether you are still in school or not, the age of consent law doesnt care about whether you are in school or not!

So just check what the laws are in your state, and if he is under the age of consent then yes, having sex with him would be illegal. However if you are not having sex and your relationship is going to stay non-sexual then thats fine, no-one is going to make a big deal out of you being together.

I hope this helps and good luck!
