writes: I am a 21 year old Female. I am completely in love with another Female who is 39 and she is in love with me too. She has two children and is afraid that if her ex husband finds out that she is with a 21 year old that he will take her to court and get custody of her children. Does anyone know anything about the law? I need help to find answers on if that could actually happen. Someone told me that there is no way that could happen because I am over the age of 18 so it is not illegal. Someone please send me a private message.

her ex-husband may try to take away the children just to be nasty but, it will take more than a gay relationship to loose your children. Although that being said some states view same sex relationships differently. If you live apart and you are both of good conduct then the ex has no grounds to win custody of the children. Just take this relationship slowly as children can become attatched to adults quickly and then you are dealing with more emotions than just yours and you girlfriends. Good luck hope the 4 of you have lots of happiness.

Unless he can prove that the kids are being harmed and/ or that she is an unfit parent, there is very little chance he could have the children taken away.
The courts generally bend over backwards to keep children with their mother, as it is usually seen to be in the best interest for them. As long as she has steady income and keeps the kids clean and well fed and safe, he really has no case.
A word of warning though, if you are living with her, you need to be up to snuff as well. She might want to have a consultation with an attorney who specializes in custody issues to see what he can legally do and what you two need to legally prove.
