I would just avoid him for now and NO...don't tell your sister!!!

Hmmm, this is a difficult question. My thoughts are that I'm not sure telling your sister would be constructive - she may be annoyed at you rather than him and he is going to either deny it or blame you.....and what is telling her going to do?
You could pretend it didn;t happen at all - like you were asleep and don;t know he did it - and see how he is around you from now on.
Or - you could calmly but assertively say something to your brother in law - so he knows you know, and knows you will not out up with it. Maybe even throw in a threat that if you see any other 'fishy' behaviour from him you'll tell your sister.
