Marriage laws between countries?

A female United States age , *urani writes:

My friend has been separated for eight years. Her husband left for France. My friend says her husband married a french woman. (They are separated not divorced.)

Can some one who is still married in his own country, marry another one in a different country. Now my friend hopes to leave for Spain and wants to to get married to her Spanish fiance. Would this two situations are possible and legal?

LazyGuy agony auntYou can only get married to one person at a time and in some places it ain't even possible to get a divorce.

So one of the is a bigamist and the other is planning to become one.

It might never come out because the police got better things to worry about but if it ever does come to court then it doesn't look good for either of them.

The EU and US work together on a lot of things and regonize each others laws. Considering that with the war on terror lots of backgrounds checks are made when you travel this may well turn up one day.

They are BOTH breaking the law, I suggest your "friend" reports the husband, would make getting the divorce through trivial.

lexilou agony auntIt doesnt matter where he was married the first time it is legally binding and what he has done is illegal. She cannot marry either unless she gets divorced soon. As he effectively abandoned her 8 years ago she may be able to get a very quick divorce through grounds of desertion.

Danielepew agony auntI understand that international law holds as valid a marriage that is recognized as such in another country. So, nobody can marry anybody else until they get a divorce.

Since your friend's husband committed bigamy (I'm speaking in Legalese, people), your friend should find it easier to divorce him. She just needs to prove he married first. All that would be required is the certificate of marriage in France.
