 If both of you are underage its not rape but it is illegal, however if you are over the age of consent and gving or recieving oral sex from a minor it could be classified as statutory rape as in the eyes of the law oral sex is regarded in the same context as penetrational sex.

reader, anonymous, writes (1 November 2006): You missed out an important bit of information - in what country are you talking about? It varies a lot depending on where you are in the world.
If you are both underage, I would imagine it wouldn't be considered rape, but if one of you is, it could be. But again, it depends on the country and it depends on the particular circumstance. e.g. is the age difference a year or two? are you in a relationship, or are there other factors; is one a teacher? Or is much younger than the age of concent, etc?
All these questions have some importance in being able to say if something is legally and/or morally right.
