Why would photo of a girl in underwear be seen as porn but photo of a girl in swimsuit is ok?

only real detail you need: I'm 17, shes also 17 and she never sent any pictures like this. so i don't understand something, about having pictures of my girl friend. Ok basically my friend said that if she ever sent me a picture to me through e-mail or a picture message of herself naked, in her panties, or bra that i would go to jail for 5 years and be marked as a paedophile till i was like 50 because its technically child pornography. then i asked him about this picture of her in her bikini (it was a picture of both of us just hanging out at the beach) and it reveals WAY more then a bra or panties ever could but he said it was perfectly legal. so if i get a picture of my girl friend in a bra thats pretty big its child porn but if i have a pic of her wearing a swim suit top that doesn't leave much to the imagination its legal?! and spending time in jail for something i couldn't control like her deciding id need a picture like that isn't fair. can someone explain this to me?

ok thank you cerberus and angeldlite, i guess that makes sense. and i don't want pictures of my girlfriend....well i do (typical teenager) but i would never ask her to ever do something like that. my friends just talk about messed up stuff sometimes and for some reason porn came up, and you can guess the rest. well thank you

HoneyEyedLatina agony auntYour friend is a complete moron. I work in the legal field (District Attorney Prosecution Unit)and it is not illegal to receive pictures of your girlfriend in her panties and bra if you are both underage. If you were over the age of 18 and she was 17 then it would be illegal to an extent but that wouldn't be the biggest issue and you wouldn't go to jail. The biggest issue would be having sex with a minor while you are 18 or older because that is considered statutory rape and that is when you could be marked as a paedophile. However, this is California Law so the laws might be different in your state. Some states do consider "17" as the adult age. I would google the laws in your state.

angelDlite agony aunta swimsuit is a functional item that we can wear out in public. underwear is only shown to another person of the opposite sex if we are intimate with them, so obviously it has sexual connotations that the swimsuit doesn't have

It's about the context, swimsuit at beach = swimming at the beach, sexy pose in underwear = sexual context.

It's just one of those things. Like your parents probably have a load of photos of you naked in the tub when you're a baby but say some stranger had those photos then that would be child porn. Now say your parents had those kind of photos but they paid particular attention to your genitals that is child porn. If a person has photos of a young child fully clothed, but the picture is in a sexy pose or is focusing on the genital region that too is child porn.

It's all about the context, you can have photos of your girl in her underwear just not in any kind of sexual context. You know? It's too much of a sexual context, it doesn't matter if her swimsuit reveals more, nor whether you think it's sexier, a swimsuit says "swimming", underwear says "sexy". The safest way to think is this, whatever she couldn't do in public is the kind of thing she can't send you in a picture.

It is fair OP, it's about protecting children form sexual predation. Once you learn the rules and understand that it makes perfect sense to make these rules you'll understand why that is. Plus you only have to wait another few months and she can legally send you naked ones if that's what you really want. Besides, if her bikini reveals more then why do you want underwear pics?
