I recently posted a question about me having sex for the first time the weekend after this upcoming weekend. Im 14 and my girlfriend is 13 and she lost her virginity last year. I posted this question on a few other sites like this one but most of the answers i got where about how its ilegal and how they think im not ready for sex. Usualy with every question someone post on here about underage sex, theres always a couple people that will say that the person is not ready and shouldnt have sex. Its different for everyone so its not too smart to assume that someone istn ready because there are millions of underage kids who have already had sex and have no regrets about it, the ones that used protection anyway.

Anyway thats all i have to say about that. Now for the question. I live in Maine in the United States. I spent about an hour last night looking up underage sex laws in Maine to get more of an idea on the subject. The only thing that I had no success in finding is what the legal punishment for having sex before the age of 16 might be. I was just wondering if anyone could help me find out exactly what i could be facing if my parents find out that i had sex with my girlfriend because im 88% sure that they will call the police.

p.s. I know that I am ready to have sex with my girlfriend and i plan to use protection. I know all the risks and possible outcomes of this and I know im ready so if thats all you can think of to reply, dont waste your time.

Here is an article on underage sex in the New England states:

It states: "Maine does not specify any particular age that an actor has to be to commit gross sexual assault. Anyone commits this crime when he has sexual intercourse with a person who has not attained age 14. Gross sexual assault is punishable by up to 40 years’ imprisonment."

Your age does not matter if she is under the age of 14, which she is. You could be 12 and it would be the same.

Ok so from what I could go to jail if anyone find out that we had sex since im older, depending on what the cops decide to do. I found that out yesterday before a posted this. My girlfriend is on the pill by the way. We're taking all the precautions i just wanted to know what to expect if my parents do find out about it.

By the way, the laws are not set by the police and it has nothing to do with how harsh the police are or if they are in a bad mood. There job is to arrest you for the offense, take you to jail while your parents call their attorney to represent you. But you will be charged with a criminal offense if you have sex with her before she is 14.

Unless kc100 is an attorney, you had better disregard her advice.

I looked up the information on a legal website and for Maine the legal age of consensual sex is 16, and it is absolutely illegal for your girlfriend to have sex at the age of 13 period, regardless of the small difference in your ages, you could be arrested an prosecuted for sexual offense as a juvenile.

Doesn't matter that she is not a virgin. By the way, "protection" condoms slip and they leak and I am pretty sure your girlfriend is not on the pill. What will you feel about regretting having sex when she becomes pregnant, and yes it only takes one time and she can become pregnant. Not to mention that she is at a very high risk on contracting HPV virus which can cause cervical cancer. She is at an increased risk, just because of her young age, and condoms do not protect against this virus, it is one of the most common human viruses and their are 43 strains of it, it can even be under your fingernails.

There is a lot more at stake here than you want to do...every action has a consequence, I hope you are ready for yours.

Illithid agony auntIn some states, it's actually considered statutory rape to have sex with a minor, even if you're one too. There are people that are on Sex Offender lists for life because they had sex as young teenagers... consensual mutual sex inside of dating. Now these people have to tell the government when they move, have to tell every new neighbor that they're convicted sex offenders, have issues being near schools, and lose a lot of jobs.

Regardless, I know you want sex, feel you're ready for it, are healthy and strong and mature (and you type much better than some college students), but sex is something you should wait for. 14 is very very very young. I'm not saying some people don't do it that young, or that every young person that has sex regrets it... but please think about it more, wait more... at the least, be dating you girl for a while first. Don't jump into sex until, say, six months into a relationship, or there's a chance that sex will change things between you two and you won't MAKE it to six months together.

and also dont rush to have sex,there is lot more time ahead.Its good that u know about protection available and interested in using it.well its illegal in any country to have sex and u can also face rape charges if caught as she is younger to u and underage.so i would like to suggest that control for sometime on ur sexual urge then there is whole life ahead to enjoy it.hope u will understand.

k_c100 agony auntFrom what I have read on the laws surrounding the age of consent in the US it is all pretty confusing, and the age of consent varies from state to state, with some allowing sex from the age of 16, and some only allowing sex from the age of 17 or 18. Regardless of this - you and your girlfriend are both underage so its not like you will be having sex with a minor.

Now what is common in most laws surrounding underage sex in the US is that you will only be prosecuted if you are 4 or more years older than the person you have sex with. So if a 14 year old had sex with a 10 year old, that definately would be a criminal offence because there is 4 years age difference despite the 14 year old still being a minor.

However in your case there seems to only be 1 year age difference between the two of you so even if your parents did report it to the police, it is quite unlikely that you would be prosecuted. Although there is still a chance that you, as the older person would be charged, with anything from sex with a minor to statutory rape. It just depends on how harsh the police are feeling.

Your safest bet is to wait until you are both legal to have sex - that way there is no chance of you getting into trouble. It just depends whether you are willing to risk having sex with her when there is a chance you could get a criminal record and maybe even go to jail. Is sex really worth all that?

It is all up to you - I cant see the police taking a 13 year old having sex with a 14 year old very seriously as it will just seem like two silly kids have been fooling around with each other to them, but there is always a chance that your parents might report you and you could face a serious punishment.
