Should I try to get the truck back from my ex?

A female Canada age 41-50, *s14 writes:

My fiance and I broke up 2 months ago. I wanted to try to work things out, but he doesn't. I still love him and keep hoping that we will get back together. Problem is I took a loan out for a truck that he is driving. I don't want to be financially attached to him for the next 4 years. I am accountable for this truck and I can'tafford to drive it.

Do I allow him to continue driving checking biweekly to see if he is making the payments or do I take him to court to get the truck.

cat lady agony auntSurely you already know the answer is YES! First time Bozo Boyfriend gets drunk and runs into somebody, YOU will be held responsible. Didn't know that? You are the owner on that title and that's who everybody is going to be looking for. Did you purchase auto insurance and write him in as a driver? Even if you did, as the owner of record, you shall be held responsible for anything that happens with it and then, just try to ever get a decent rate on your insurance again; you're considered a 'bad risk.'

Why do you need to take him to court to get it back?? Do you have any written and notarized agreement with this person about use of that vehicle? Has he picked up payments, legally arranged with your creditors? (if you have lien-holders, you do not have a legal right to make these arrangements independently) If not, and he tries to continue use of it without your consent, that is called THEFT, and Grand Theft at that. Call the cops, NOW. My mother always told me as a child, "Lie down like a rug and you shall certainly be walked on." If your own didn't tell you the same, it's never too soon to learn it.
