Most banks do say they will refund Identity Fraud so if you have been hit and RBS don't offer any help then offer to take your business elsewhere. Their profits are in free fall so they might respond to that.
The thing is that your details weren't stolen, it was your fault for being silly and giving them to someone, even though you were tricked into it. I'm not having a go but I can see why the bank would say that they don't HAVE to give you the cash back.
This may just be an expensive mistake that you have to learn from. Sorry!
Good Luck!! xx

Frankly I'm amazed that people still get taken in by these scams. You name a bank and I guarantee I've had a spam email supposedly from them.
Use Yahoo! for your emails - it automatically puts this sort of crap into a spam folder and you can delete them, and all the other the emails for replica watches, medications, viagra, penis extensions etc etc etc, with three clicks of the mouse, all in one go.
