writes: i cant stress the fact that i didn't ask her to do this more. just randomly one day my girl friend send me via e-mail a picture of her from the waist up but no shirt and just a bra, i deleted it a day later because when i first got it i wasn't curtain how to react. just kinda a smile and sitting up on the couch, wouldn't be sexual at all if she had a shirt on. i do not know if i could get her or my self in trouble for this happening, shes 16 years old (im 17 as of last month) and i think thats technically child porn. so I'm scared now that i might get charged with possession of it and she might get charged with distribution of it even though i was the only person with the picture and its deleted now. she said one if her friends dared her to do it, so now i feel like she has crappy friends also. can someone please tell me if this is illegal, and if i did the right thing (and if not what i should have done), and how i can prevent this from happening again.

reader, anonymous, writes (2 June 2013): This is not illegal just as long as you didn't send the pic to anyone if you deleted the picture you should be fine if the cops find out the most they will do is ask you if you got rid of them and did you send them to anyone else. I speek from experience I am 15 she was 16 cops found out I didn't get charged was just asked my parents to stay away from her.

Bad judgment on her part, excellent judgment on yours. I don't think it crosses the line into illegal, but you did the right thing. And if this is what her friends have dared her to do, yes, she does have crappy friends.
Don't make a massive issue out of it, but it might be a good idea to give your girlfriend a hint that you thought it was risky behavior.

Obviously she trusts you not to spread it around so you did right by deleting it since it was only meant for your eyes only. But even though it is "illegal" you wouldn't go to jail for it.

You did exactly the right thing by deleting it.
Any photo of a sexual nature of a minor is classed as child porn. Even if the minor took the picture themselves, it is still classed as child porn.
The authorities are cracking down on things like this now, as these photos can get out of hand and get into the WRONG hands. You did the right thing and deleted it... others may have emailed it to their friends, who then email it to their friends... and then suddenly there is a picture of your girlfriend half naked on an internet porn site. And she is underage - there you have child porn.

You were totally spot on with your gut feelings here, and I applaud you for doing the right thing! Many boys your age would not have been so mature.
If your girlfriend continues to send you photos like this while she is still a minor, delete them. Perhaps have a little word with her and explain why she shouldnt be doing this. Her friends think they are being cool, sexy and grown up by doing this, they think that 'sexting' makes them mature. It doesnt, it just makes them silly little girls as they do not understand the implications of what COULD happen to those photos.
You sound like a great boyfriend and you care a lot about her, ultimately having her best interests at heart. Keep it up! :)
@strongfp - your comments would be perfectly ok for two consenting adults, here the girl is 16 and a minor and there are laws which do relate to this kind of thing. You cannot work in porn until you are 18 - anything below this is considered 'child' porn.

In the state I live in if you are 16 and 17 it is legal to have sex with someone who is between the ages 16 and 19, and any sexual contact with someone under fourteen is considered statutory rape, consensual or not. Now as long as you are not distributing it you should be safe. Though if you are fearful look up the local state laws on sexual acts and tell your girlfriend you enjoyed the picture but would not like to receive them anymore till of legal age. Personally plenty of underage women in bikinis are on the web and completely legal to look at, and bras and bikini tops are practically the same. It shouldn't be possession of child porn because she is clothed.I hope I helped!Cheers
