 He's leading you on. He's young, and entitled to play the field. Unless you know that he's for sure over with her, don't go for it, you could end up making a serious enemy if she thinks you're with her boyfriend when she's got plans of getting back with him as seen as their relationship is on/off.
I've been in the same situation, sort of, but me and the guy haven't made conversation and I don't think he's taken.
You're probably going to accept that he's gunna play around a bit until he's older and his hormones calm down. But don't try getting with him until you know that they've called it of for definate.

 What you see is what you get. If you can't tell then he's not being clear enough, is he?
Ask him about the girlfriend. Or better yet, ask the girlfriend about it directly. That should help clear things up.
