writes: Does anyone on here know about criminal law and what a family member should do? We live in Canada. A family member (25) was visiting us the other night, had supper and drank approx. six beer over the course of a six hour period. He left the house to go drive to his own home about an hour after his last beer was consumed. He did not appear drunk. However on the way home he was changing the radio station, got distracted, where he ran a red light and he was t-boned by another vehicle. The occupants of the other car were okay, thankfully. But here is where he amde a serious lack of good judgement. Our family member, panicked at the scene and ran away before the police arrived. He drives for a living and thought he'd lose his license on the spot and wouldn't be able to work. He wasn't think rationally and he regrets what he did--now. He turned himself in to the police 36 hours later. He has never had a criminal record or ever been in trouble with the law before. He's never even had a parking ticket! He is deeply remorseful for what he did and is prepared to face the consequences. Does anyone have any idea what he should do? We have never had an incident like this happen...does he need a lawyer? He is being charged with 'failing to remain at the scene of the accident'. Is this a criminal charge? Will he do jail time? Has anyone of you out there (from Canada) had this happen to you and what did you do? Or do you know of someone who had this happen to them? Thanks in advance.

It is illegal to flee from an accident (not to mention running a red light and causing an accident), and he could be convicted. Whether he does jail time is up to the judge, but I believe that this is a moving violation so he might lose his job regardless. He should definitely contact a lawyer.

I don't think he will as he wasn't the 1 driving but he should tell the police because he was a witness!
