The child usually stays with the person who has been providing most of the care (babysitting/feeding/bathing/changing) and usually also with the person who is in the family home. At such a tender age its usually the mother, but we don't know your situation because these days many fathers are providing more care than mothers. Its better to come up with an amicable agreement with your ex. Don't try to punish her using your child as a whip. If you know that the child is best with her mother then leave it at that and just spend time with baby regularly.

reader, anonymous, writes (16 December 2009): Mom's usually win, unless you can prove she's unfit - hard to do w/o an arrest and some good evidence- or video of something really bad. Odds are good you're going to need to stay close, and be ready to pay about 20 years of child support. I'd make the divorce as simple and cheap as you can- the kid needs the money more than some lawyer.

Well I think legally child support can take your kid until then. I'd advise splitting the time evenly and NOT involving the legal system yet. You guys should be able to be civil until court.
