Should I ask her out or just be her best friend?

A male age 41-50, anonymous writes:

I met this girl for weeks and found out she had a boy of 2 years old, but not legally married to the man, asking her if she still in love with this man, which is say No. I ask her why and reply me with 'it personal' i ask her if they had contact on phone she says once in a while and that she dont care , but you have a boy for him, she still say they same words. I love this girl and have not ask her out. What do i do? Should i ask her out or be best friend?
