Hello there.I am not qualified as a chemist so please take my response with a pinch of salt.
Hydroquinone is used as a component of skin whitening creams and you are right in some countries it's use in this manner has been deemed illegal (France) because of fears of causing cancer. It's woth noting that diffrent countries will have different safety laws.

I think a better question would be if it is necessary to use skin lightening cream? Just a thought.
