As long as you are both of legal age and he no longer is grading you in any fashion, it's completely legal. However a 10 year age difference in a relationship that was formerly student/teacher might be frowned upon by his employers (not to mention your family) so I'd take great care in being discrete until you're willing to risk the consequences.
