Yes, an engagement is not a legal process - although it used to be. So you can set the date fro your wedding at any time at all.

Absolutely! You are entitled to get engaged as it is just a promise to marry (just do not get married before the divorces come through!). However, divorce is a stressful situation for many people and depending on how straight-forward it is for both of you, it may well be a more pleasant experience to leave the engagement party until you are both officially single again. Hopefully it will be second time lucky for both of you!
