 The laws in the USA regarding the age of consent are a complete mess and vary from state to state. If I understand them correctly, then nowhere is it legal for anyone of any age to have sex with a 13-year-old. Parental approval or disapproval doesn't enter into it. It's highly likely he would go to jail, but again the penalties vary from state to state.
And, even more bizarrely, it depends where you are when you do it. Doing it outside the USA, assuming you are citizens of the USA and once he is 18, makes it a federal offence punishable by up to 30 years in prison.

 If you are having sex,and get caught out, then yes he could. The Law is there to protect you and other girls your age. Although your boyfriend is only 17, he is still classed as an adult, where as you are still classed as a child. When you are 17 and he is 21, it wont be so bad.
