I think your mum could get custody of you right now. You can llegaly live on your own at 16, so if you wanted to wait untill then, you wouldnt have to do the custody thing, but your dad might complain.
Talk to your mum about it :) she should sort it for you.
Also is it not worth trying to repair your relationship with your dad first?

reader, anonymous, writes (4 October 2009): Before your parents divorced they would have had to come to an agreement over who had residence and who had access.(who you lived with and who you visited.)This can be done by mutual agreement or by fighting in court.Mutual agreement is far better and if that is what happened then your best bet is to persuade them to mutually agree that you live with your mum.If its not done mutually and ends up in court things get messy and very expensive for your parents if they arent elligible for legal aid.How does your mum feel about you living with her. TBH i doubt theres much your dad could do if your mum was happy to have you live there full time.If he is working it would cost him a fortune to fight in court.
