I'm 15 going on 16 and my boyfriend's 19 going on 20. my mom's bitchin cuz she think where havin sex when were not. she want's me to take a virgin test, but i'm sure i'll fail. and his gonna be locked up. how am i gonna get my mom to listen to me, and can she do any thing when i turn 16?

This is from VA Code

§ 18.2-63. Carnal knowledge of child between thirteen and

fifteen years of age.

A. If any person carnally knows, without the use of force, a

child thirteen years of age or older but under fifteen years

of age, such person shall be guilty of a Class 4 felony.

B. If any person carnally knows, without the use of force, a

child thirteen years of age or older but under fifteen years

of age who consents to sexual intercourse and the accused is

a minor and such consenting child is three years or more the

accused's junior, the accused shall be guilty of a Class 6

felony. If such consenting child is less than three years

the accused's junior, the accused shall be guilty of a

Class 4 misdemeanor.

In calculating whether such child is three years or more a

junior of the accused minor, the actual dates of birth of

the child and the accused, respectively, shall be used.

C. For the purposes of this section, (i) a child under the

age of thirteen years shall not be considered a consenting

child and (ii) "carnal knowledge" includes the acts of

sexual intercourse, cunnilingus, fellatio, anilingus, anal

intercourse, and animate and inanimate object sexual

penetration.

The age of consent in Virginia is 18, with a close in age exception which allows teenagers aged 15, 16 and 17 to engage in sexual acts, but only with a partner younger than 18. However the legislation is not clear cut and the details are discussed below:

Any penetrative sexual act other than penile-vaginal intercourse is defined in Virginia law as 'sodomy.' Section 18.2-361 of the Code of Virginia entitled "Crimes against nature" states in part;

"If any person carnally knows in any manner any brute animal, or carnally knows any male or female person by the anus or by or with the mouth, or voluntarily submits to such carnal knowledge, he or she shall be guilty of ... felony..."

In addition, any sexual intercourse is defined in Virginia law as 'fornication.' Section 18.2-344 of the Code of Virginia entitled "Crimes against nature" states;

"Any person, not being married, who voluntarily shall have sexual intercourse with any other person, shall be guilty of fornication, punishable as a Class 4 misdemeanor."

The courts of Virginia have ruled that these statutes are not invalid under the US Supreme Court's decision in Lawrence v. Texas since that case only applied to adults, and the age of majority in Virginia is 18. This means that those 18 and above involved in consensual activity in private may have a defense in court, but those under 18 do not.

Section § 18.2-63 of the Code refers to minors younger than 15, while § 18.2-371 is about 15, 16 and 17 years olds.

Section 18.2-63 states in part:

"If any person carnally knows, without the use of force, a child thirteen years of age or older but under fifteen years of age, such person shall be guilty of ... felony ... For the purposes of this section, (i) a child under the age of thirteen years shall not be considered a consenting child and (ii) "carnal knowledge" includes the acts of sexual intercourse, cunnilingus, fellatio, analingus, anal intercourse, and animate and inanimate object sexual penetration."

Consensual sex where one partner is 15, 16 or 17 and the other is over 18 is a class 1 misdemeanor.

§ 18.2-371. Causing or encouraging acts rendering children delinquent, abused, etc.; penalty; abandoned infant. Any person 18 years of age or older, including the parent of any child, who (i) willfully contributes to, encourages, or causes any act, omission, or condition which renders a child delinquent, in need of services, in need of supervision, or abused or neglected as defined in § 16.1-228, or (ii) engages in consensual sexual intercourse with a child 15 or older not his spouse, child, or grandchild, shall be guilty of a Class 1 misdemeanor

Anyway the only thing an OBS/GYN can tell is if your hymen (a very thin bit of skin in your vagina) is intact.

The breaking of the hymen was a sign in Victorian days (late 19th Century) that a girl had lost her vaginity. But that was when ladies rode side saddle and didn't do the splits or ride bikes.

So is you have ever done the splits rode a horse or bike, the chances are your hymen will be broken. So there is no way to tell if you have lost your virginity.

Depending on what state you live in determines the age of consent. It is possible he could get in trouble if you are sleeping with each other. Your mom seems a little scared to lose you I think you are probably old enough to decide for yourself if you want a dr looking at your genitals. She can not force you to go to the dr to see if you are still a virgin and no self respecting dr will check for her just because she's afraid her daughter is sexually active. Besides that your hymen can break without have intercourse so there is no sure fire test to say you actually had sex for all they know you use "novelty" items. My mom use to freak me out all the time with that crap. She never went through with any of that. Your mom is probably trying to scare you into talking to her about it. If I were you I would go to your local court house ask for the statutes on age of consent they may be able to help you.btw what state do you live in. If we knew what state it might help someone might know the age of consent. I know in my state age of consent is 14 as long as the other partner is not more than 2 yrs older. Hope your mom calms down.

there is no such thing as a virgin test! your mum is probably just saying that to see your re-action.

you need to get her to trust you. simply talk to her about it and say you are not ready for sex, but when you feel that you are you will go to her if you need any advice.
