From my knowledge statutory rape is sex, that being oral intercourse etc. This is mostly from me following a case of a young man recieving oral sex from a 15 year old a going to jail (extreme but true)

and so yes it is illegal and charges can be pressed agianst you. Either way i would wait until your completly legal anyway, you may think screw the law but stuff happens and you dont want to be bite on the ass later on.

Thank you for that link, it has been very helpful I'm enlightening me on what is considered Statutory Rape and what is not. How ever it simply states "intercourse". What is considered "intercourse"? I understand your analogy completely, however, we have "petted" but I do not know if its considered "heavy petting". Are things considered "Foreplay" also considered "intercourse"? Or is "intercourse" only consist of sex?

Do a search on "age of consent by state" and you'll see that the age of consent in CA is 18. I think the full text is here though you should check for yourself.

My opinion about the ethical thing to do would be to wait for actual intercourse until her 18th birthday. 16 really does seem young for responsible sex. As for the other stuff, well, I think the more "heavy petting" you do, the harder it may be to stay celibate (like promising yourself you're not going to take a bite of cake till your birthday, but allowing yourself to sniff it, cut yourself a slice, etc. rather than putting it in the cupboard for later.)
Give your girlfriend the information, so she can help make the decisions with you about when to do what. Good luck!

I understand what you are saying but I want to know if there is statue of limitations on statutory rape. We both love each other very much and we both feel like then next step would be okay, but we are both worried as to what kind of trouble I may get into if what goes on ever does actually happen. I also want to know what is considered statutory rape (i.e. just intercourse? Or does oral sex and other forms of sexual activities other then actual intercourse count as well) Thank you for your advice. If you can answer my additional questions added in this follow up, that would be great!

hey dude in this situation pretty much say screw the laws, uve obviously been going out long enough and the age gap really isnt that big,
and the chance of anyone finding out is pretty slim
